The current U.S. health care system, with both rising costs and demands, is unsustainable. The combination of a sense of individual entitlement to health care and limited acceptance of individual responsibility with respect to personal health has contributed to a system which overspends and underperforms. This sense of entitlement has its roots in a perceived right to health care. Beginning with the so-called moral right to health care, the issue of who provides health care has evolved as individual rights have (...) trumped societal rights. The concept of government providing some level of health care ranges from limited government intervention, a ‘negative right to health care’, to various forms of a ‘positive right to health care’. The latter ranges from a decent minimum level of care to the best possible health care with access for all. We clarify the concept of legal rights as an entitlement to health care and present distributive and social justice counter arguments to present health care as a privilege that can be provided/earned/altered/revoked by governments. We propose that unlike a ‘right’, which is unconditional, a ‘privilege’ has limitations. Going forward, expectations about what will be made available should be lowered while taking personal responsibility for one’s health must for elevated. To have access to health care in the future will mean some loss of personal rights and an increase in personal responsibility for gaining or maintaining one’s health. (shrink)

The first feature film made about the design and deployment of the atomic bomb, The Beginning or the End (1947), begins with fake newsreel footage depicting the burial in a time capsule of a copy of the film and a projector to show it on. The scene, with its funereal overtones yet grim optimism that, even in the face of catastrophic destruction, the germ of civilization will endure, recalls the ceremonies surrounding the interment of the Westinghouse time capsule at the (...) New York World’s Fair in 1939. Time capsules, this article argues, stand in a complex relation to war and temporality, seeking to at once anticipate and work through the challenge posed to futurity by the threat of global conflict. As a container, the capsule attempts to deliver and control the reception of a legible inventory of the present, yet the principle of selection and the impossibility of predicting how information might be received in the deep future – if it is received at all – threatens this aim. The dilemma faced by time capsule curators is, we argue with reference to William Burroughs’ and Brion Gysin’s so-called cut-up method of writing, one of control. By reading the time capsule through the cut-up, anticipated catastrophe can be seen to be functioning proleptically in the present and already active as a challenge to the capsule as proof against disaster. The thought-experiment presented by Bernard Williams in 'The self and the future' continues to draw the attention of writers in the debate about personal identity. While few of them agree on what implications it has for the debate, almost all agree that those implications are significant ones. Some have even claimed that it has consequences not only for personal identity, but also concerning the viability of thought-experiment as a method. This paper surveys what these consequences might be at both levels (...) - as a substantive contribution to the debate on identity, and as to what it shows about the usefulness of thought-experiments. It argues ultimately that thought-experiments like Williams's do provide a useful philosophical tool as long as we temper our expectations of them, and that it offers some support to a view of personal identity but one which is at odds with Williams's own view. Probably Holzberg had nothing to do with the choice of the cover, which was designed only to attract buyers. If he did, he would have been ironically aware of the surprises he had in store for unsuspecting readers: there is little in this book to excite the average modern satyr. Instead of titillating his audience with erotic images, Holzberg focuses our attention on the elegiac system, from which, as he shows, the poet Ovid ingeniously worked.The reader receives warning in the foreword, where Holzberg says little about the historical personage Ovid but directs us instead to the variety of roles the poet Ovid developed in his different works. It is these roles that have familiarized us with Ovid, not the historical facts that have accumulated around him [End Page 651] outside his poems. Holzberg declares, then, that he wishes to read Ovid’s poetry as “novels,” that is, as fictional accounts by a fictional speaker who uses the first person.Before proceeding to the poetic works in chronological order, Holzberg devotes two important introductory chapters to discussing his approach first to the work, then to the poet. That of course reverses the order of his subtitle, but by way of correction: this writer and this book are primarily interested in the poetry that Ovid created and that we can still critically read: the poet is far more problematical. So we start with a paradox: our present time is an Ovidian Age (aetas Ovidiana), as was the era in cultivated Western Europe about a thousand years ago. We probably read Ovid today as well as, if not better than, the people who rushed to multiply Ovidian manuscripts in that previous era. However, the question is: do we read and hear Ovid with the awareness of those original Roman audiences, nearly a millennium earlier, who enjoyed what we may consider the first aetas Ovidiana, when Ovid himself was present to register his amazing effects in Rome (and to recall them fondly in exile)? The answer that Holzberg produces is: no, we don’t read Ovid as a Latin audience; instead, we pick out what makes him like us, modern. To read his works as Holzberg wants, then, we must first grasp the features which belong to the doctus poeta. Ovid was what Holzberg calls “a poet between texts” (a clever variation on Fraenkel’s famous phrase for Ovid, “a poet between two worlds”). That stresses the literary practice of intertextuality rather than the cultural interrelationships that occupied Fraenkel and his contemporaries. It also justifies the role of Holzberg, who steps in to help the helpless “modern reader” and to explain some of the key intertexts that functioned directly for Ovid’s first audiences. Similarly, a modern reader needs to step back from the trap of the plausibly witty story that Ovid’s first-person speaker narrates, to appreciate the conventions with which the poet ably plays for the amusement of his well-read audiences; and this means understanding what Holzberg calls the “elegiac system,” which serves as the basis of all Ovid’s work. Recognizing the fundamental elements of the system, we can see better how he modifies and innovates with familiar material, whether it is a form like that of the exclusus amator or the interesting variations he creates on the “slavery of love.”Holzberg’s approach to Ovid the poet is deliberately skeptical. Our only contemporary “evidence” about him is the dubious and fictional series of details and events which emerge from the mouth of the “speaker” in the poems. A Road to Philosophy of Mathematics l became interested in philosophy and mathematics at more or less the same time, rather late in high school; and my interest in the former certainly influenced my attitude towards the latter, leading me to ask what mathematics is really about at a fairly early stage. I don ’t really remember how it was that I got interested in either subject. A very good math teacher came to my school when I was in (...) 9th grade and I got caught up in his course on solid geometry; but he soon left and math then lost its luster again in the hands of teachers who neither liked nor understood it. Calculus wasn’t taught in high school in those days, or at least not in mine: besides geometry we learned some algebra and trigonometry. I doubt that even the word “ philosophy ” passed the lips of any of my teachers. My mother, who worked for a publishing house, brought home for me copies of, among other works, the Jowett translations of Plato’s Dialogues, Will Durant’s Story of Philosophy and Courant and Robbins’ What Is Mathematics?; but I can’t remember why she did that: She wasn’t at all intellectual and, as far as I recall, my interests at the time were mostly confined to sports and girls—in some order. Maybe she just thought it was time for me to develop new interests. After high school, I went in 1948 to Lehigh University, then at least primarily an engineering school, on an athletic scholarship. There I had the good fortune in my first year to have an introduction to philosophy course with Lewis White Beck. He had just moved there from the University of Delaware and shortly thereafter moved on to the University of Rochester, where he became one of the leading lights of American Kant studies. My good luck was compounded when, in my second year, Adolph Gr¨ unbaum arrived at Lehigh, fresh from graduate school at Yale, and stayed at least long enough for me to graduate, before moving to the University of Pittsburgh as Andrew Mellon Professor of Philosophy of Science.. Using concepts from Ulrich Beck's Risk Society, this paper argues that as expertise proliferates questions of ethics in decision-making fall through gaps between domains of expertise. As a consequence, unethical outcomes are unattached to actions taken with no one accountable or responsible for these outcomes. Using Actor-Network Theory, a case study is presented showing how the sale of students' personal information by the Calgary Board of Education escaped questions of ethics. The sale of student information was the product of (...) the convergence of narrowly focussed technology and education expert actions and decisions with an earlier two-stage translation of privacy from a potential ethical issue to an issue of expert rule creation and interpretation. The purpose of this paper is to show, through an example, how questions of ethics are displaced in expert decision-making and to enable the public, managers, individuals and experts to recognize displacements and, through this, create a space for ethics to appear. Zetemata 110. Munich: C. H. Beck, 2001. 206 pp. Paper, fi49.90. In mid-February 2001 at the University of Freiburg, a symposium was held under the aegis of Professor Eckard Lefèvre on the theme "Lucilius, Identity, and Alterity." Moving with lightning speed, Gesine Manuwald edited fifteen of the papers (...) given there and had them ready in June so that Beck could publish them in record time. This is the swiftest production of the doings of such a symposium that I have come across. If only there had been some really new things to say about Lucilius, it would make this monograph invaluable. Unfortunately, no new fragments have appeared, and the identity of Lucilius remains shrouded in mystery for lack of new historical evidence. As for alterity, most of the participants in the project did not feel comfortable with addressing that aspect of Lucilius, probably again for lack of useful data on the satirist and his period.Nine of the fifteen papers come from the hands of students and faculty at the University of Freiburg. In addition, there are contributions from Johannes Christes of Berlin, C. J. Classen of Göttingen, Ursula Gärtner of Leipzig, Severin Kostner of Erlangen, Werner Krenkel of Rostock, and Eckart Olshausen of Stuttgart. All of the titles try to link Lucilius with a genre like epic, with a specific poet like Callimachus or Aristophanes, or with a cultural or historical phenomenon like the city of Rome or the times in which the poet lived. One essay alone addresses a specific satire, predictably the Trip to Sicily in Book 3, which provides enough surviving lines to allow a discussion of fifteen pages.Several of the essays illustrate the difficulty of putting a confident hand on the "identity" of Lucilius. Even the famous disclaimer of ambition to become a [End Page 153] publican in the new province of Asia, though firmly linked to Lucilius' name in its text, does not necessarily justify the conclusion that the poet is expressing personal pride as Manuwald claims. A pose is certainly struck, but what exactly is Lucilius proud of, and what does he propose instead? The statement could be the opening to his artistic creed as satirist, but it has other possibilities, e.g., the choice of an Epicurean existence or an attack on equestrian operators, and we need to advance every inference very tentatively. It is indeed quite possible that the lines came from a fictional dramatic situation.The first paper, by Ulrike Auhagen, deals with Lucilius and comedy, an important and difficult topic. In his early poems of the first edition, Lucilius wrote a number of scenes in comic meters. Before he completed that edition, he seems to have decided permanently against those meters, senarius and septenarius, and he confined himself to hexameters in Book 30, the last book of that edition. Did he also abandon the way he used the comic meters? That is, in his early satirical experiments, did he produce little comic vignettes on fictional situations, familiar in Plautus and Terence, or did he use comedy to make satiric commentary on the Rome of his day? If the former, which I had hoped Auhagen would consider, then we can infer the variety of the satura that the poet was exploring. If the latter, then Lucilius is already from his earliest works the hard-hitting moralist that Auhagen imagines, ready to turn any meter and any situation into an arena for his polemics. I would plead for more openness to alterity.Various papers deal with Lucilius' interest in other genres or writers. Thus, Andreas Bagordo downplays the connection with Callimachus, which Puelma Piwonka daringly argued. Bernhard Zimmermann considers Horace's apparent belief that Lucilius depended greatly on Aristophanes, and he puts it rightly into perspective. Manuwald shows how little the satirist admired the Greek and Roman tragedians, but she could have spent more time on the programmatic relevance of his disapproval: he was, after all, staking... Exploration of Alfred North Whitehead's influence on Maurice Merleau-Ponty's ontology of nature.

Plato's Sophist provides a careful translation of the Sophist, one of Plato's most complex and difficult dialogues, and includes materials designed to facilitate its usefulness as a text in college courses. The translation employs a minimum of interpretative paraphrasing while being presented in clear, readable English. Special attention has been given to consistency in translating key Greek terms. The book presents a special list of these terms and discusses them in the endnotes. The result is a translation that enables the (...) reader who lacks a knowledge of Greek to get much closer than usual to the original text. Cobb's introduction contains a detailed summary of the entire dialogue, clarifying the main themes and the general structure. He offers a fresh interpretation of the dialogue that shows how each theme contributes to the exploration of the nature of, and the relation between, philosophy and sophistry. This article defends epiphenomenalism against criticisms raised in Dwayne Moore’s “On Robinson’s Response to the Self-Stultifying Objection”.

Medical decision making often utilizes subjective observations to arrive at concrete judgments. The decisions frequently affect who receives scarce medical treatments and, thus, who lives or dies. In this paper, a model health status index is described. It is specific for the problem of choosing patients for hemodialysis or transplantation. Such a health status index may be designed for any medical decision involving such issues as drug treatment priorities, identification of salvageable patients, and selection of patients for scarce medical treatment. This index (1) incorporates a physician''s own medical criteria and values, (2) can be modified as the data base improves, (3) assures consistency from decision to decision, and (4) can be developed and used without the help of a mathematician or computer. Frank Jackson has abandoned his famous knowledge argument, and has explained why in a brief "Postscript on Qualia" . This explanation consists of a direct argument, and an attempt to explain away the intuition that lies at the heart of the knowledge argument. The direct argument is clarified and found to be subtly question-begging. The attempt to explain away the key intuition is reviewed and found to be inadequate. False memory traces, which Jackson mentions at the beginning of the direct (...) argument, are discussed and found not to materially affect the force of the knowledge argument. (shrink)

The formal systems of logic have ordinarily been regarded as independent of biology, but recent developments in evolutionary theory suggest that biology and logic may be intimately interrelated. In this book, William Cooper outlines a theory of rationality in which logical law emerges as an intrinsic aspect of evolutionary biology. This biological perspective on logic, though at present unorthodox, could change traditional ideas about the reasoning process. Cooper examines the connections between logic and evolutionary biology and illustrates how logical (...) rules are derived directly from evolutionary principles, and therefore have no independent status of their own. Laws of decision theory, utility theory, induction, and deduction are reinterpreted as natural consequences of evolutionary processes. Cooper's connection of logical law to evolutionary theory ultimately results in a unified foundation for an evolutionary science of reason. This paper offers an account of why the Hard Problem cannot be solved within our present conceptual framework. The reason is that some property of each conscious experience lacks structure, while explanations of the kind that would overcome the Hard Problem require structure in the occurrences that are to be explained. This account is apt to seem incorrect for reasons that trace to relational theories of consciousness. I thus review a highly developed representative version of relational theory and explain why (...) I do not find it acceptable. This rejection requires a nonrelational alternative, which I describe and defend against a certain further objection. Finally, I discuss implications of the foregoing for the views of McGinn and Chalmers. (shrink)

This book traces how Adorno's reconsideration of history through his readings of Kant's Critique of Judgement are distinct from formulations offered by other thinkers. More than any of them though, Adorno's aesthetics has introduced an alternative thought, (...) which, Allen shows, has been modified and extended in the work of Peter Weiss and other contemporary thinkers. Because of Paul’s egalitarianism evidenced in his concern for an inclusive salvation that did not discriminate against gentiles, it is widely assumed that Paul opposed all ethnic distinctions as contrary to the message of Christ. A close look at his letters, especially the letter to the Romans, shows that whilst Paul, because of his belief in the impartiality of God, argues against discrimination, he does differentiate clearly between Jew and Greek and does not oppose ethnic distinctions as such. What Paul (...) opposes is the hostility that emerges from a failure to recognize and accept the other in their distinctive identity. He is thus an advocate of social and cultural diversity rather than of uniformity. (shrink)

This paper evaluates the rhetoric of the U.S. bishops' pastoral letter on the U.S. economy from two perspectives. Is the letter convincing? Does it conform to the conversational norms of civilization? The paper argues that the bishops' letter fails by both standards because it ignores serious research on the U.S. economy, it misstates important facts about the economy, and it sneers at professional economists. The paper concludes that the bishops' letter will not be convincing to well informed readers.

The following pages attempt to develop the main outlines of an existential phenomenology of law within the context of Maurice Merleau-Ponty's phe nomenology of the social world. In so doing, the essay addresses the rather narrow scholarly question, If Merleau-Ponty had written a phenomenology of law, what would it have looked like? But this scholarly enterprise, although impeccable in itself, is also transcended by a more complicated concern for a very different sort of question. Namely, if Merleau-Ponty's phenomenological descriptions of (...) the social world are correct-as I believe they largely are-then what are the philosophical consequences for an adequate understanding of law? Such a project may well occasion a certain surprise amongst observers of the contemporary philosophical landscape, at least in what concerns the terrain of continental thought, and for two different reasons. The first is that, although interest in Merleau-Ponty's work remains strong in the· United States and Can ada, his philosophical standing in his own country has been largely eclipsed! by that of, first, his friend/estranged acquaintance, Jean-Paul Sartre; by various Marxist philosophies and critical social theories; and finally by those doing her meneutics of language. In my view, current neglect of Merleau-Ponty's thought in France is most regrettable. (shrink)

This response to Professor Hasnas recasts the apparent divergence between the legal and ethical obligations of managers in light ofthe rhetorical claims and counterclaims that accompany the interaction between regulators and the regulated. It is argued that this divergence is more apparent than real, and that the convincing but often empty rhetorical statements that accompany reforms should be seen in context and largely disregarded. Since the most promising path to a solution to the problem of skepticism regarding perceptual knowledge seems to rest on a sharp distinction between perceiving and inferring, I begin by clarifying and defending that distinction. Next, I discuss the chief obstacle to success by this path, the difficulty in making the required distinction between merely logical possibilities that one is mistaken and the real (Austin) or relevant (Dretske) possibilities which would exclude knowledge. I argue that this distinction cannot be drawn (...) in the ways Austin and Dretske suggest without begging the questions at issue. Finally, I sketch and defend a more radical way of identifying relevant possibilities that is inspired by Austin's controversial suggestion of a parallel between saying I know and saying I promise: a claim of knowledge of some particular matter is relative to a context in which questions about the matter have been raised.
